Terms of Service

These Terms of Service (“Terms”) govern your use of That Party Never Ends, including our website, Celebration Pages, accounts, contributor features, purchases and related services.

By creating an account, purchasing a package or otherwise using services requiring acceptance of these Terms, you agree to them.

1. About That Party Never Ends

That Party Never Ends Digital Memorials (“That Party Never Ends,” “TPNE,” “we,” “us,” or “our”) provides online tools for creating and sharing Celebration Pages containing stories, photographs, memories, music, video links and contributions from family and friends.

Our service is intended to help people remember and celebrate someone's life.

2. Eligibility

You must be at least 18 years old to create a TPNE account or purchase a paid package.

By creating an account or making a purchase, you represent that you meet this requirement and that information you provide to us is reasonably accurate.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You must not knowingly allow another person to impersonate you, gain unauthorized access to TPNE or use your account for unlawful purposes.

Please notify us at support@thatpartyneverends.com if you believe your account has been compromised.

4. Celebration Managers

The person who creates or is assigned management of a Celebration Page (“Celebration Manager”) controls that Celebration subject to these Terms and the features of the applicable package.

The Celebration Manager may be able to:

• edit the Celebration;
• add or remove content;
• control privacy settings;
• invite contributors;
• review contributions;
• approve, hide or remove memories; and
• manage other Celebration features.

A Celebration Manager is responsible for using these controls appropriately.

5. Packages and Pricing

TPNE currently offers:

Premium and Legacy are offered as one-time package purchases with no recurring package fee.

The currency applicable to your purchase will be clearly identified before payment.

Package features, limits and prices may change for future purchases. Changes to future pricing do not retroactively change the amount already paid for a completed purchase.

Unless expressly stated otherwise, purchasing a package does not constitute a promise that TPNE or any Celebration Page will be hosted for an indefinite period.

6. Payments

Paid purchases are processed through TPNE's checkout and third-party payment providers.

You agree to provide accurate payment and billing information and authorize the applicable charges displayed before completing your purchase.

Payment processing may also be subject to the payment provider's terms.

7. Refund Policy

Premium and Legacy purchases may be eligible for a refund when requested within 14 days of purchase.

A refund may be limited or declined where the paid service has already been substantially used, including circumstances involving extensive uploading, substantial contributor activity, creation or use of downloadable materials, or other significant use of paid features.

We may consider exceptional circumstances individually.

Approved refunds will ordinarily be returned through the original payment method where technically available.

Nothing in this policy limits rights or remedies that cannot lawfully be excluded under applicable consumer-protection law.

8. Content You Provide

You retain ownership of original content you own and submit to TPNE.

You grant TPNE a non-exclusive licence to host, store, reproduce, resize, format, display, transmit and otherwise process that content as reasonably necessary to operate, secure and provide the service.

This licence does not transfer ownership of your content to TPNE.

You are responsible for ensuring you have the necessary rights or permission to upload or publish content.

9. Photographs, Copyright and Third-Party Content

Do not upload or publish material that you do not have the right to use.

This includes copyrighted photographs, recordings, artwork, written material and other protected content.

TPNE may allow links or embeds from services such as YouTube. Providing an embed does not give TPNE or the user ownership of the underlying video or music.

Third-party content remains subject to the third party's availability, terms, copyright rules and technical controls.

We may remove or restrict content in response to a valid legal complaint or where we reasonably believe it violates these Terms.

10. Contributors

Celebration Managers may invite other people to contribute.

Contributors remain responsible for content they submit.

Where moderation is provided, a contribution may remain unpublished until approved by the Celebration Manager.

Removing someone's contributor access does not necessarily delete previously submitted or published content. That content may need to be managed separately.

11. Respectful and Lawful Use

TPNE is designed for remembrance and celebration.

You must not use TPNE to publish or distribute content that:

• is unlawful;
• knowingly infringes intellectual-property rights;
• impersonates another person fraudulently;
• contains malware or malicious code;
• attempts to compromise TPNE or another user's account;
• exposes highly sensitive information about a living person without appropriate justification or permission;
• constitutes targeted harassment, threats or abuse; or
• otherwise seriously interferes with the safety or operation of the service.

We may investigate reported content and take reasonable action, including restricting access or removing content where appropriate.

12. AI Writing Assistance

TPNE may provide optional AI-assisted writing tools.

AI-generated drafts may contain errors, omissions or wording that does not accurately represent the person being remembered.

You are responsible for reviewing and editing AI-generated material before using it.

AI-generated content is never automatically published by the writing-assistance feature.

TPNE does not guarantee the accuracy, completeness or suitability of AI-generated content.

13. Celebration Availability

We work to maintain reliable access to TPNE, but websites and online services occasionally experience outages, maintenance, security incidents or circumstances beyond our reasonable control.

We do not guarantee uninterrupted or error-free operation.

A Premium or Legacy one-time package purchase means there is no recurring package fee for that package under the terms offered at purchase. It does not constitute a guarantee of continued hosting or service availability.

14. Changes to the Service

We may improve, modify, replace or discontinue features as TPNE evolves.

Where a material change significantly affects a paid service, we will make reasonable efforts to communicate the change and consider appropriate remedies where circumstances warrant.

15. Closing an Account or Celebration

Users may request closure or deletion through available account controls or by contacting support.

Before deleting a Celebration, consider whether other family members or contributors may want to preserve its content.

Certain information may remain temporarily in backups or may be retained where reasonably necessary for transaction records, fraud prevention, security, dispute resolution or legal obligations.

16. Management After Death or Incapacity

TPNE may receive requests to transfer management of a Celebration where its manager has died, become incapacitated or is otherwise unable to manage it.

We may request reasonable evidence before transferring control and may decline or delay a transfer where ownership, authority or family circumstances are disputed.

Our goal in such circumstances is to protect the Celebration and the people connected to it rather than granting access without adequate verification.

17. Suspension and Termination

We may restrict or suspend an account or Celebration where reasonably necessary to:

• protect TPNE or its users;
• investigate suspected fraud or unauthorized access;
• respond to legal requirements;
• address serious or repeated violations of these Terms; or
• prevent misuse of the service.

Where appropriate, we will attempt to provide notice and an opportunity to resolve the issue.

18. Third-Party Services

TPNE relies on third-party services for parts of its operation, potentially including hosting, payment processing, email, embedded media and AI processing.

Those services may have separate terms and privacy policies.

We are not responsible for independent third-party websites or services outside TPNE's reasonable control.

19. Disclaimers

TPNE provides a platform for users to create and share Celebration Pages.

We do not independently verify every story, photograph, date, memory or statement submitted by users.

To the extent permitted by law, the service is provided on an “as available” basis, without guarantees that every feature will always be uninterrupted, error-free or available indefinitely.

Nothing in these Terms excludes warranties, rights or remedies that cannot legally be excluded.

20. Limitation of Liability

To the extent permitted by applicable law, TPNE and That Party Never Ends Digital Memorials will not be liable for indirect, incidental, special or consequential losses arising from use of the service, loss of access, third-party services or user-submitted content.

Any limitation in these Terms applies only to the extent permitted by applicable law.

Nothing in these Terms limits liability where doing so would be prohibited by law.

21. Governing Law

These Terms are governed by the laws applicable in the Province of Nova Scotia and the federal laws of Canada applicable therein, without limiting any mandatory consumer rights that may apply based on a customer's location.

22. Changes to These Terms

We may update these Terms as the service changes.

Material changes will be communicated in a reasonable manner. Where required, users may be asked to accept updated Terms before continuing to use certain services.
